Agreement Between WVU, Big East Spells Out Settlement


A settlement agreement, obtained by through use of the Freedom of Information Act, spells out the settlement between WVU and Big East, which became official Tuesday.

The document (which can be viewed here) is the end to about four months of legal battle between the school and its soon to be former conference.

The Mountaineers would not be entitled to any NCAA Tournament credits from this season, nor would it receive any withdrawal fees paid from a school that submits a Withdrawal Notice, such as Pittsburgh or Syracuse.

West Virginia is asked to use its "reasonable best efforts" to help the Big East members schedule additional football games for the coming season and notes that should Pittsburgh or Syracuse make such a request on or before February 15, 2012, WVU should work to help those schools add a Big 12 member to their fall schedule if possible.

If another school were to announce that it is joining the Big East for the coming football season, WVU would no longer be held to the that portion of the agreement.

A major factor in the settlement are the payment terms, which state that in addition to the $2.5 million WVU paid the Big East in October, it would include all WVU conference revenue distributions and reimbursements for the 2011-12 seasons.  There is also a "settlement payment," the amount of which is undisclosed.

WVU may elect to have a third party make all or any portion of the payments on its behalf and must have the money to the Big East by Friday, Feb. 17, 2012.

Either party may terminate the agreement by written notice if there is a "significant material breach" by another party.

The agreement contains the signatures of both Big East commissioner John Marinatto and WVU Vice President for Finance and Administration, Narvel G. Weese.
